1. Who this policy covers
Fix Failed Payments (“Fix Failed Payments,” “we,” “us”) provides software that helps U.S. collection agencies draft, review, and send consumer communications. This policy describes how we handle information when you visit fixfailedpayments.com, create an account, or use the product.
We serve businesses, not consumers in their personal capacity. If you received a collection letter, email, or text that mentioned this website, please read our FDCPA Statement. We are not the debt collector on that message.
2. Roles: controller and processor
Agency accounts. For your login, billing, and organization profile, we decide how that data is processed and act as the controller.
Consumer (debtor) records. Names, contact details, account numbers, balances, and similar information that your team uploads or generates in the product are processed on your instructions. Your agency is the controller of that consumer data; Fix Failed Payments is the processor. We do not use consumer records to market to consumers or to build unrelated profiles.
3. Information we collect
Account and billing data may include:
- Name, work email, organization name, role, and authentication data
- Plan, usage counts, and payment status (card details are handled by Stripe, not stored on our servers)
- Support tickets, audit of operator actions, and messages you send to us
When you use the product we also process:
- Consumer records and communication content your team imports, drafts, edits, or sends
- Consent, vulnerability, and outcome flags you record
- Delivery events from email or SMS providers (for example bounces), without storing extra consumer PII in those event logs where we can avoid it
- Technical logs needed to operate the service (IP address, timestamps, error reports)
Our public site uses cookieless page-view analytics (Umami). Query strings are excluded so invite tokens and checkout session ids are not sent to analytics. Error reporting (BugSink) is configured not to capture cookies, request bodies, or extra personal identifiers.
4. How we use information
- Provide, secure, and improve the software, including AI-assisted drafting and compliance checks
- Send communications you approve, using the email or SMS providers you configure or that we operate on your behalf
- Bill subscriptions, prevent abuse, and comply with law
- Contact you about the service, security issues, and (if you opt in) product updates
Draft generation may send prompts and merge fields to DigitalOcean Gradient AI Inference solely to produce the draft you requested. Do not put secrets unrelated to the draft (API keys, passwords) into prompts or consumer records.
5. Sharing
We share information only as needed to run the product:
- Infrastructure and database hosting for the application
- DigitalOcean Gradient AI Inference for AI draft generation, classification, and weekly summaries
- Stripe for payments
- Email and SMS providers you connect (for example Postmark or Twilio) to deliver messages you send
- Umami (self-hosted) for aggregate site analytics and BugSink for application errors
- Authorities when required by law, or professional advisors under confidentiality
We do not sell personal information or share it for cross-context behavioral advertising.
6. Security and retention
Consumer contact fields are encrypted at rest. Access is role-based inside each organization. The audit log is append-only so a record of material actions can be produced for examinations.
Organizations can configure communication retention and auto-purge in Settings. Audit-chain entries are kept so the history remains verifiable. We retain account data for as long as the organization is active and for a limited period afterward as needed for billing, disputes, and legal obligations.
7. Your rights and consumer requests
Agency users may access or update their account profile and, depending on role, export or delete organization records through the product or by emailing hello@fixfailedpayments.com.
Consumers seeking access, correction, deletion, or an explanation of a collection communication should contact the agency that sent it. That agency is the controller. We will assist our customers with verifiable requests they are legally required to fulfill.
8. Children
The service is for business users. It is not directed at children under 16, and we do not knowingly collect personal information from children.
9. Changes
We will post updates on this page and change the date above. Material changes may also be announced in the product or by email to organization owners.
